CAIRYA  Terms of Use

Welcome to Cairya These Terms of Use ("Terms") govern your use of the Cairya application ("App") a browser and VR/AR platform that provides virtual avatars powered by AI to instruct assist and coach in various areas. By using this app you agree to comply with these Terms. If you do not agree please refrain from using the App.

1. Age Restrictions

Cairya is intended for users of all ages However individuals under 13 must have parental or guardian consent to use the App. If local laws in your region impose additional age restrictions you must comply with those regulations.

2. Health and Safety Warnings

By using the Cairya App, you acknowledge the inherent risks associated with virtual reality (VR) and augmented reality (AR), which may include but are not limited to: Motion sickness, Dizziness, Eye strain, Disorientation, Seizures (for those with certain conditions). If you experience any discomfort, stop using the App immediately. Consult a medical professional before continuing use if you have any health concerns or pre-existing conditions that might be affected by VR/AR usage. The App is not designed to substitute medical advice, and you should consult a professional regarding any health or safety concerns.

3. AI Disclaimer

Cairya provides advice, instructions, and coaching powered by artificial intelligence (AI). The content provided by AI avatars may include but is not limited to education, mental wellness, personal growth, and life coaching.

You acknowledge that:
- Cairya’s AI is a tool to assist, not a substitute for professional advice (e.g., legal, medical, financial, or psychological).
- You must consult relevant professionals before following any advice, particularly related to health, fitness, or mental wellness.
- Cairya is not liable for any actions or decisions you make based on the AI’s recommendations. The use of the App is at your own risk.

4. Data Collection and Privacy

Cairya collects data solely to improve user experience and track progress. This includes:
- User progression data (e.g., milestones, completed tasks, session transcripts and  summary) to tailor your experience.
- Data is stored securely and is not shared with any third parties.

By using the App, you consent to the collection and use of this data as outlined in our Privacy Policy (below). For more information, please review our Privacy Policy.

5. User Conduct

When using the Cairya App, you agree to adhere to the following conduct rules:
- Do not use the app for any illegal or unauthorized activities.
- Do not harass, threaten, or abuse other users or avatars.
- Do not attempt to manipulate or interfere with the performance of the app.
- Do not use the app to spread misinformation, harmful content, or engage in any fraudulent activity.

Violation of these rules may result in the suspension or termination of your access to the app.

6. Limitation of Liability

You acknowledge that the App is provided "as is" and "as available." While Cairya aims to deliver a high-quality service, the company:
- Is not liable for any personal injury, property damage, or losses resulting from VR/AR and browser use.
- Does not guarantee any particular outcome from following AI-driven advice.
- Is not responsible for interruptions, bugs, or errors in the service.

Your use of the Cairya is at your own risk, and Cairya disclaims any liability arising from your use or misuse of the app.

7. Changes to the App and Terms of Use

Cairya is a dynamic platform and will be regularly updated to improve features, content, and functionality. These updates may affect your experience but will not change the core purpose of the app.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting within the app or through other communication channels. Continued use of the app after changes constitutes your acceptance of the new Terms.

8. Jurisdiction and Governing Law

These Terms are governed by the laws of the state of NJ, USA. Any disputes arising from the use of the app will be resolved in the courts of NJ. Users located outside of the USA agree to comply with all applicable local laws and regulations in their jurisdiction.

Cairya Privacy Policy

This Privacy Policy explains how Cairya (“we,” “our,” or “Cairya”) collects, uses, shares, and protects information when you use the Cairya application (“App”), including browser and VR/AR experiences.

When you register and use the App, we collect:

Account Information

  • Name, email address, age, gender you provide at sign-up.

Usage and AI Interaction Data

  • Text transcripts of your conversations with AI avatars.

  • AI-extracted facts about you from those conversations.

  • Session summaries and progress information.

  • Analytics data about how you use the App (anonymized and aggregated).

2. How We Use Your Information

We use your data to:

  • Provide and improve the App’s features, including personalized AI coaching and instruction.

  • Store and display your session transcripts and summaries.

  • Understand user behavior to improve app quality and performance.

  • Diagnose bugs, manage support, and perform quality checks.

3. AI Services and Third-Party Providers

Cairya uses third-party AI services (e.g., OpenAI) to power avatar responses. When we send data to these providers:

  • You remain the owner of your input and output data created by the AI.

  • By default, OpenAI does not use API data to train or improve its models unless you explicitly opt in; they may retain data briefly for abuse monitoring and compliance purposes. OpenAI Platform

  • We do not share your personal data with third parties for their own marketing or advertising.

4. Analytics and Aggregated Data

We may collect usage analytics to understand how the App is used. This data is:

  • Aggregated (not tied to your name or account).

  • Used only to improve product performance and user experience.

5. Data Access, Deletion, and Controls

You have control over your data:

  • You can delete your session data directly in the App at any time.

  • To delete your account, contact us at contact@cairya.com or via the App’s support feature.

  • We do not offer a direct data export feature today.

6. Children’s Privacy

Cairya does not knowingly collect personal information from children under 13 without parental or guardian consent. If we become aware that we have collected such information without appropriate consent, we will take steps to delete it. Parents or guardians may contact us at contact@cairya.com with any concerns.

7. Security

We use reasonable administrative, technical, and organizational safeguards to protect your data. However, no system is perfect, and we cannot guarantee absolute security.

8. Changes to This Policy
